ระบอบประชาธิปไตย ( Democracy ) หมายถึง ระบบการปกครองที่ประชาชนเป็นใหญ่ ดังนั้นการปกครองที่เป็นประชาธิปไตยก็คือ รูปการปกครองที่ยึดถืออำนาจอธิปไตยเป็นของปวงชน

ประเทศที่เป็นประชาธิปไตยนั้นจำเป็นต้องมีรัฐธรรมนูญ เพราะรัฐธรรมนูญเป็นกฎหมายหลักหรือเป็นกติกาที่กำหนดแนวทางสำหรับการที่รัฐจะใช้อำนาจปกครองประชาชน และมีหลักการจัดระเบียบการปกครองแต่รัฐธรรมนูญก็ไม่ใช่เครื่องหมายแสดงความเป็นประชาธิปไตย เพราะประเทศที่ปกครองด้วยระบอบเสด็จการก็มีรัฐธรรมนูญเช่นเดียวกัน การที่จะพิจารณาว่าประเทศใดเป็นประชาธิปไตยหรือไม่ จึงต้องดูว่ารัฐธรรมนูญของประเทศนั้นให้ประชาชนเป็นเจ้าของอำนาจอธิปไตยหรือไม่

ลักษณะสำคัญของการปกครองแบบประชาธิปไตยสามารถพิจารณาได้จาก รัฐบาล การเลือกตั้งและการปกครองโดยเสียงข้างมาก


รัฐบาลในระบอบประชาธิปไตย

- รัฐบาลโดยประชาชน หมายถึง ประชาชนหรือพลเมืองทุกคนมีสิทธิที่จะเป็นผู้ปกครองได้ ถ้าหากได้รับเสียงสนับสนุนจากประชาชนส่วนใหญ่ของประเทศ

- รัฐบาลเพื่อประชาชน หมายถึง รัฐบาลจะต้องมีจุดประสงค์เพื่อความผาสุกของประชาชน และจะต้องมีการกำหนดวาระในการดำรงตำแหน่ง เช่น ทุก 4 ปี ฯลฯ เพื่อจะได้เป็นหลักประกันว่าผู้ปกครองจะต้องปกครองเพื่อประชาชน หากผันแปรจากจุดหมายนี้ ประชาชนจะได้มีโอกาสเปลี่ยนผู้ปกครองผ่านทางการเลือกตั้ง
