If Lay time does not cease within 5

If Lay time does not cease within 5 (five) days after tender of NOR, the Buyer may at any time or times thereafter require that the Seller: (a) pay to the Buyer the demurrage accrued as at the date of the Buyer’s demand, which demurrage shall be immediately due and payable; and (b) make payments to the Buyer in respect of demurrage accruing every 5 (five) days following the demand, which demurrage shall be immediately due and payable at the end of every 5 (five) day period. Subject to the foregoing, demurrage shall be due and payable within 14 (fourteen) days of presentation by the Buyer of an invoice and statement concerning lay time and demurrage. The Buyer shall have the right to set-off or deduct from payment of the Price any demurrage accruing.
