Please find attached herewith the first instalment of your draft witness statement on the invalidation issues. In this draft, I have only covered the train patent vis-à-vis claim 1 of the ‘862 Patent. As it is probably the most substantial piece of prior art and has dominated a large part of our discussions during our meetings in Chicago, KL and Beijing, all parties may need more time to consider the draft. Hence, in the interest of time, I am now sending this part of the draft witness statement, and will follow up within the next couple of days with the draft covering the train patent vis-à-vis claims 2-12 of the ‘862 Patent and the discussion on other prior art docs cited.
