根据我国《劳动法》的规定，只有书面劳动合同才是双方当事人建立劳动关系的唯一合法形式。但实践中，无书面劳动合同的事实劳动关系却大量存在。造成这种现状的主要原因是我国现行的劳动合同制度存在诸多缺陷。要解决这一问题，必须对现行的劳动合同制度进行改革。
