摘要】危险驾驶罪在实际司法运作中还存在定案标准、定案依据、罪名选择、办案态度等诸多不足，本文在研习大量学术论文及查阅相关案例的基础上，从法条的文理解释、刑法罪名的构成要件、罪的形态、法院的裁判依据等阐述危险驾驶罪在实践中存在的问题。并从法的价值、功能，刑法的谦抑性、日美等国的做法方面做了法理思考。
