INFOR Nexus’ Support obligations do not include the right to access new or bundled product offerings made available by INFORNexus, unless access to such offerings is separately purchased. INFOR Nexus will not have any obligation to provide Supportfor problems in the operation or performance of the INFOR Nexus Platform to the extent caused by any of the following: (a)modifications to the INFOR Nexus Platform made by a party other than INFOR Nexus; (b) Member’s use of the INFOR NexusPlatform other than as authorized by the applicable agreement granting access to Member or as provided in the Documentation;or (c) Member’s failure to use any error corrections or updates thereto provided by INFOR Nexus to address a Service Issue.If, in its sole discretion, INFOR Nexus determines that a problem in the operation or performance of the INFOR Nexus Platformis caused by the foregoing, then INFOR Nexus will notify Member promptly and have no further Support obligations related tosuch problem.
