WTO成立专家组，于2003年7月15日公布报告，裁定日本的《1999 病虫害分析报告》(1999 Pest Risk Analysis，简称1999 PRA)不符合SPS协定第5.1条的风险评估要求，日本对美国苹果的进口限制违反了SPS协定第2.2条的科学原理要求，且不能根据该协定第5.7条得到正当解释，不属于在相关科学证据不充分的情况下实施的临时性植物卫生措施，并建议DSB要求日本履行日方根据该协定应承担的义务,取消对美国苹果的进口限制。
