The products must comply with the agreed description (e.g. specifications, data sheets, drawings) and any up-to-date samples provided. Unless otherwise agreed, Winmate’s description of the products and submission of samples shall not constitute an assurance of any properties. In each case, Winmate shall check without delay whether a description provided by BARTEC is in any way incorrect, unclear, incomplete or does not comply with the product sample. Should Winmate realise that this is the case, it shall inform BARTEC in writing immediately.
