Confidential Information shall not include any information that Recipient can demonstrate with competent evidence (i) is or becomes known in the public domain through no fault of Recipient; (ii) is already in the possession of the Recipient without restriction at the time of disclosure; (iii) is rightfully received by Recipient from a third party without a breach of such third party's obligations of confidentiality;
