neither Discloser nor its suppliers are responsible or liable for any problems, claims, losses or damages of any sort incurred as the result of the use of (or inability to use) any of the Samples, and Recipient shall indemnify, defend and hold Discloser harmless from any and all liability, losses, costs, damages and expenses arising out of or relating to any third party claim or demand caused by the willful, reckless, intentional or negligent conduct of Recipient relating to the use outside the scope of the Purpose.
