大连海关缉私局移送审查起诉认定: 为逃避海关监管, 获取非法利益, 大连毅都集团有限公司(以下简称毅都集团公司)采取低报价格的方式, 走私进口国家允许进口的水果以及采取伪报品名的方式走私国家禁止进口的水果. 自2012年8月至2015年1月, 毅都集团公司低报价格走私进口水果153个集装箱, 偷逃税款1500070.99元. 2013年1月至2015年1月, 毅都集团采取伪报品名的方式走私禁止进口水果16个集装箱, 共计344.088吨, 发票价格3859726.3元.

经本院审查并退回补充侦查, 本院仍然认为本案証据不足, 不符合起诉条件. 依据第一百七十一条第四款的规定, 决定对大连毅都集团有限公司不起诉.

扣押的大连毅都集团公司的现金请侦查机关予以返还; 冻结的大连毅都集团账户请侦查机关解除冻结.

被不起诉单位如不服本决定, 可以自收到本决定书后七日内向本院申诉.
